Terms of Use

1. Who we are

Vital is an iOS app operated by LMS Labs Ltd, a private limited company registered in Scotland (company number SC888839). The directors are Mason Hillan, Scott Anderson, and Lee Gordon.

2. The short version

These terms are the contract between you and us when you use Vital. The plain-English version:

  • Vital is not a medical device. The scores, insights, and AI replies are informational. They are not a diagnosis. Don't make medical decisions based on what Vital tells you, talk to a clinician.
  • You own your content. Your HealthKit data, food logs, mood notes, photos and chat history belong to you. We get a narrow licence to process them so the app works.
  • The paid AI tier is an auto-renewable subscription through Apple, billed monthly or yearly after a free trial. Apple handles the money and the refund policy. We don't take card details. If you were granted Vital AI before we moved to subscriptions, you keep it free for life.
  • Don't reverse-engineer, scrape, or abuse the service. Don't try to get into other people's accounts. Don't use Vital to harass anyone or do anything illegal.
  • You can delete your account in one tap from Settings. We can suspend an account that's breaking these terms, but it's a last resort, we'd usually email first.
  • Scottish law governs the contract. Your statutory consumer rights under UK law are not affected by anything in here.

3. Accepting these terms

By creating a Vital account, signing in, or otherwise using the app, you confirm that you have read, understood, and agreed to these terms. If you don't agree, don't use Vital.

You must be at least 13 years old to use Vital. If you are between 13 and 16 you must have a parent or guardian's permission. We recommend Vital for ages 16 and over because it is a health-tracking app and the scores are designed to be read by an adult. If you are signing up on behalf of a child between 13 and 16, you confirm you have authority to do so.

If you are using Vital on behalf of an organisation, you confirm you have authority to bind that organisation to these terms.

4. Your account

You are responsible for the security of your account. That means:

  • Keeping your sign-in credentials private. Don't share them.
  • Telling us as soon as you suspect someone else has accessed your account, email business@lmslabsltd.com.
  • Keeping your information accurate (your sex, date of birth, height, weight, etc) so the scores reflect your physiology.
  • Using the biometric lock (Face ID / Touch ID / passcode) we provide in Settings if anyone else has physical access to your phone.

One person, one account. Sharing an account between multiple people produces nonsense scores and is a violation of these terms.

5. Licence to use Vital

Subject to your continued compliance with these terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use Vital on iOS devices you own or control, for your own non-commercial use.

This licence does not let you:

  • Copy, modify, distribute, sell, or sublicense the app or any part of it.
  • Reverse-engineer, decompile, or disassemble the app, except where applicable law expressly permits it.
  • Remove any copyright, trademark, or other proprietary notices.
  • Use the app to build a competing product or to train a machine-learning model.

The Vital name, wordmark, and the brushed-steel "V" crest are owned by LMS Labs Ltd. You don't get any rights in them under these terms.

6. Acceptable use

You agree not to:

  • Use Vital for any unlawful purpose, or to facilitate one.
  • Submit content that is illegal, defamatory, harassing, threatening, hateful, or that infringes someone else's rights.
  • Attempt to access another user's account, data, or operator panel.
  • Probe, scan, or test the vulnerability of our systems, or breach our security or authentication measures, except under a coordinated disclosure programme we have agreed to in writing.
  • Send automated traffic, scrape, or impose an unreasonable load on our servers.
  • Send food-log content, chat messages, or photos that contain other people's personal data without their consent.
  • Misrepresent your identity or affiliation.
  • Interfere with the normal operation of Vital, or with another user's enjoyment of it.

If you find a security vulnerability, please email business@lmslabsltd.com rather than exploiting it. We'll acknowledge within five working days and credit you in the changelog if you'd like.

7. Your content

"Your content" means everything you create or upload through Vital: HealthKit data Vital reads on your behalf, the workouts and exertion entries you log, food entries, mood check-ins, chat messages, progress photos, and user-profile fields.

You own your content. By using Vital, you grant us a worldwide, royalty-free, non-exclusive licence to host, store, transmit, and process that content solely for the purpose of operating the Vital service for you, for example, to compute your scores, render your feed, generate AI insights you have requested, or sync between your devices. This licence ends when you delete the content or your account, except where we are legally required to keep a backup or audit copy (see the Privacy Policy for retention details).

We will not sell your content. We will not use your content to train third-party machine-learning models. AI features are described in Section 8.

8. Vital AI

The optional paid tier (Vital AI) adds:

  • Daily written insights generated from your recent health snapshot.
  • A chatbot that can answer questions using your live data.
  • AI macro estimation from food photos.
  • AI analysis of progress photos against your weight and body-comp trend.

These features are powered by Anthropic's Claude models, accessed through a server-side proxy operated by us. When you use them, a snapshot of the relevant data plus your message is sent to Anthropic in the United States, returned to you, and not retained by Anthropic for model training. The full data flow and the relevant safeguards are documented in the Privacy Policy.

AI replies can be wrong. Large language models hallucinate, miscount, and confidently produce plausible-sounding nonsense. Treat AI insights as a discussion starter, not a verdict. Cross-check anything that matters before acting on it. Never use an AI reply to make a clinical decision.

9. Subscriptions and payments

The free tier of Vital is and will remain free. It gives you scoring, logging, and widgets with no time limit.

Vital AI is an auto-renewable subscription sold through Apple's In-App Purchase system. There are two plans in one subscription group:

  • Vital AI Monthly, £7.99 per month, renewing every month.
  • Vital AI Annual, £50 per year, renewing every year.

The prices and renewal periods you see at the point of purchase are the ones that apply. The figures above are the launch prices in pounds sterling; if you buy in another currency, or if we change the price for new subscribers, the App Store shows the current price before you confirm.

New subscribers get a 3-day free trial. The trial starts when you subscribe, and you are not charged during it. If you buy a plan while a free trial is still running, any unused part of that trial is forfeited at the moment of purchase. One trial per subscription group, subject to Apple's eligibility rules.

Payment is charged to your Apple ID when you confirm the purchase. The subscription renews automatically at the same price for the same period unless you cancel at least 24 hours before the current period ends. Apple charges the renewal to your Apple ID within the 24 hours before each period ends.

You manage or cancel the subscription yourself in your Apple ID settings: Settings → [your name] → Subscriptions on your device, or App Store → account → Subscriptions. Cancelling stops the next renewal; you keep Vital AI until the end of the period you have already paid for. Deleting the app does not cancel a subscription.

Apple processes the payment, holds your card details, and applies its standard refund policy. Apple's terms apply to the purchase as well as ours. If a charge is missing, duplicated, or you want a refund, contact Apple Support first, they own the receipt and can refund it. If Apple needs information from us to process a refund, we'll supply it.

If you owned the earlier one-off Vital AI purchase before we moved to subscriptions, that purchase still works: open the paywall and tap Restore previous purchase on a new device and your lifetime access comes back.

Grandfathered access. Anyone granted Vital AI before the switch to subscriptions, including everyone who came in through the waitlist, keeps Vital AI free for life. You are never charged, never moved onto a paid plan, and never downgraded if a subscription you don't have happens to lapse. This is permanent.

10. Health disclaimer

Vital is not a medical device. It is not registered with the MHRA, FDA, or any other medical regulator. The Recovery, Exertion, Stress, Health, and Readiness scores, the cycle phase predictions, the AI insights, the AI chat replies, and any other output of the app are informational and educational only.

Vital does not, and is not intended to:

  • Diagnose, treat, cure, or prevent any disease, condition, or injury.
  • Replace advice from a qualified clinician, dietitian, physiotherapist, mental-health professional, or any other regulated practitioner.
  • Provide emergency care. If you think you are having a medical emergency, stop using the app and call 999 (UK), 112 (EU), or your local emergency number.

Always consult a qualified clinician before changing your diet, training, sleep, medication, or any other health-related behaviour based on something Vital has shown you. If a number on Vital alarms you, a sudden spike or drop in resting heart rate, a sleep stage that looks abnormal, an unusual mood pattern, treat it as a prompt to speak to a professional, not a verdict.

11. Availability and changes to the service

We aim to keep Vital running, but we don't promise specific uptime or that the service will be uninterrupted, error-free, or available in every territory. Vital depends on third-party services (Apple HealthKit, Apple Push, Anthropic, Supabase) that have their own outages from time to time.

We may add, change, or remove features. If we materially reduce a feature you have already paid for, we will email any registered users so you can decide what to do. Minor changes, fixes, and improvements happen continuously without notice.

12. Suspension and termination

You can stop using Vital and delete your account at any time, in one tap, from Settings → Privacy & Security → Delete account. Doing so deletes your data within 30 days as described in the Privacy Policy.

We can suspend or terminate your access if you breach these terms in a way that is serious, repeated, or that puts other users or our service at risk. Where we can, we will email you first, explain the issue, and give you a chance to put it right. Where we can't, for example because the breach is causing immediate harm, we will act first and explain afterwards.

Sections 7 (your content licence to us, narrow scope), 10 (health disclaimer), 13 (limitation of liability), 14 (indemnity) and 17 (governing law), and any other section that by its nature should survive, will survive termination.

13. Limitation of liability

Nothing in these terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot be limited or excluded under English or Scots law, including your statutory rights as a consumer under the Consumer Rights Act 2015.

Subject to that:

  • Vital is provided "as is" and "as available". We make no warranties about accuracy, reliability, fitness for a particular purpose, or non-infringement, except those that cannot lawfully be excluded.
  • We are not liable for indirect or consequential losses, loss of profit, loss of business, loss of opportunity, or loss of data, however caused.
  • Our total aggregate liability to you for any claim arising out of or in connection with Vital, in contract, tort (including negligence), or otherwise, is limited to the greater of (i) the total amount you have paid us for Vital in the 12 months immediately before the event giving rise to the claim, or (ii) £100.

This section reflects an allocation of risk between you and us that is reflected in the price you pay (which is zero for the free tier).

14. Indemnity

If your misuse of Vital, your breach of these terms, or your infringement of someone else's rights causes us to be sued, fined, or otherwise out of pocket, you agree to cover our reasonable costs, including legal fees on the standard basis. We will tell you about the claim promptly, give you reasonable control of the defence (provided you don't settle in a way that admits our liability), and cooperate at your cost.

15. Third-party services and the Apple App Store

Vital is distributed through the Apple App Store and uses several Apple frameworks (HealthKit, StoreKit, Push Notifications). Apple's own terms apply to your download and your in-app purchases. Apple is a third-party beneficiary of these terms and may enforce them against you, although you contract with us, not Apple. Apple is not responsible for the app or for any claims arising from it, that's on us.

Vital integrates with Anthropic (AI), Supabase (backend storage), and optionally Google (sign-in). Their terms apply to those parts of the experience. We are not responsible for the actions of these third parties beyond our role as the processor that wires them up.

16. Changes to these terms

When we change these terms materially, changing what you owe us, changing the way we can suspend an account, or anything else that meaningfully shifts the deal, we will:

  1. Update the Effective date at the top.
  2. Surface an in-app notice the next time you open Vital.
  3. Where the law requires it, ask you to re-accept before the change applies to your continued use.

For non-material changes (typo fixes, clearer wording), we'll just bump the Last updated date. The current version is always available at this URL.

17. Governing law and disputes

These terms, your use of Vital, and any non-contractual obligations arising out of them are governed by the law of Scotland. The Scottish courts have non-exclusive jurisdiction over any dispute, which means we agree to bring claims there but you remain free to bring a claim in the courts of the country where you live if local consumer law gives you that right.

Before going to court, please email us, most issues are quicker to fix that way.
